How are Party organizations that violate Party discipline dealt with, and what is the impact on their members?

According to the "Regulations of the Communist Party of China on Disciplinary Actions," the handling of Party organizations is mainly divided into two situations: For Party organizations that generally violate Party discipline, the higher-level Party organization should order them to make a written self-criticism or give them a warning; For Party organizations that seriously violate Party discipline and cannot correct themselves, the higher-level Party committee, after verification, may reorganize or dissolve them according to the severity of the circumstances.

When a Party organization is reorganized, members of that Party organization's Organizational Chart, except those who should be given the punishment of removal from Party posts or above, will be automatically relieved of their posts.

Specific situations should be grasped according to the following circumstances: 1. For those who are found to have serious disciplinary violations and should be given the punishment of removal from Party posts or above after review, they will be given the punishment of removal from Party posts or above, and there is no need for automatic relief from their posts; 2. For those who are found to have disciplinary violations and should be given a warning or serious warning after review, they will be given a warning or serious warning and automatically relieved of their posts; 3. For those who are found to be suspected of disciplinary violations but cannot be clarified in a short period of time, they will be automatically relieved of their posts first, and then their suspected disciplinary violations will be dealt with separately; 4. For those who are found to have no disciplinary violations after review, they will be automatically relieved of their posts.

When implementing, for members of the leading bodies of Party organizations who are automatically relieved of their posts, the following should be noted:

1. After automatic relief from their posts, all Party posts held in that Party organization and its subordinate Party organizations are automatically revoked. For example, if a municipal Party committee is reorganized, the posts of standing committee member, director of the Organization Department of the municipal Party committee, and delegate to the municipal Party congress held by the standing committee member and director of the Organization Department of the municipal Party committee are all automatically relieved.

2. After automatic relief from their posts, if the non-Party posts held are closely related to the posts of members of the leading body of the Party organization, it is usually recommended that the non-Party organization relieve them of their non-Party posts. For example, after the Party group of a municipal finance bureau is reorganized, the post of member of the Party group of the municipal finance bureau held by the deputy director of the municipal finance bureau is automatically relieved, but the post of deputy director of the municipal finance bureau needs to be relieved separately.

3. After automatic relief from their posts, the standing committee members of the local Party committee who are the main officials of the provincial military region (garrison area, military sub-district), military sub-district (military sub-district), and the people's armed forces department of counties, autonomous counties, cities without districts, and municipal districts, after the local Party committee is reorganized, their posts as standing committee members and committee members of the local Party committee are automatically relieved, but their posts as main officials of the provincial military region (garrison area, military sub-district), military sub-district (military sub-district), and the people's armed forces department of counties, autonomous counties, cities without districts, and municipal districts are not within the scope of automatic relief from their posts.

4. After automatic relief from their posts, for those who are members of the leading body of the reorganized Party organization and are also cadres on secondment, all Party posts held in that Party organization and its subordinate Party organizations are automatically revoked, but their posts in their original units are not within the scope of automatic relief from their posts.

5. Automatic relief from posts is a disciplinary measure and should be implemented in accordance with Article 11 of the "Regulations of the Communist Party of China on Organizational Handling (Trial Implementation)" on the consequences of relief from posts.
When a Party organization is dissolved, the Party members in the Party organization should be reviewed one by one.

The handling is mainly divided into three situations: 1. Those who meet the conditions of Party members should be re-registered and participate in the Party life of the new organization; 2. Those who do not meet the conditions of Party members should be educated and given a time limit for correction. Those who remain unchanged after education should be persuaded to withdraw or expelled; 3. Those who have violated discipline should be investigated according to the regulations.

 

 

In what circumstances can punishment be mitigated or reduced?

The "Regulations of the Communist Party of China on Disciplinary Actions" stipulates that if any of the following acts are committed, the punishment may be mitigated or reduced:

(1) Actively confessing to issues that should be subject to Party discipline.

"Active confession" refers to a Party member suspected of violating discipline confessing their problems to the organization before the organization's conversation and inquiry, preliminary verification, or confessing problems that the organization does not know during the conversation and inquiry, preliminary verification, and case investigation.

(2) Cooperating with the verification and investigation work and truthfully stating the facts of their disciplinary violations during the organization's conversation and inquiry, preliminary verification, and case investigation.

This situation refers to the Party member under review truthfully stating the facts of their disciplinary violations that the organization has already grasped during the organization's conversation and inquiry, preliminary verification, and case investigation.

(3) Reporting on issues that should be subject to Party discipline or legal prosecution by accomplices or others, which have been verified to be true, or have other meritorious deeds.

"Accomplices" refer to those who jointly participated in and committed disciplinary violations, including both Party members and Party organizations, as well as non-Party members and non-Party organizations.

"Others" refer to those who did not jointly participate in or commit disciplinary violations, including both Party members and Party organizations, as well as non-Party members and non-Party organizations.

"Other meritorious deeds" refer to providing important clues to other cases, preventing others from engaging in illegal and criminal activities, assisting in the arrest of other persons under investigation or criminal suspects (including accomplices) in cases of duty-related crimes, and recovering losses for the state.

(4) Actively recovering losses, eliminating adverse effects, or effectively preventing harmful consequences from occurring.

"Actively recovering losses" refers to the act of a Party member who has violated discipline actively taking effective measures to recover losses after their disciplinary violations have caused losses.

"Eliminating adverse effects" refers to the act of a Party member who has violated discipline actively taking remedial measures to eliminate the adverse effects after their disciplinary violations have caused adverse effects.

"Effectively preventing harmful consequences from occurring" refers to the act of a Party member who has violated discipline, who has already begun to commit disciplinary violations but has not yet caused harmful consequences, actively abandoning the continuation of disciplinary violations, and actively taking positive measures to prevent the occurrence of harmful consequences.

(5) Actively handing over or returning illegal gains.

This situation refers to actively handing over illegal gains to the organization. It does not include returning illegal gains to the gift-giver, etc.

(6) Other circumstances for mitigating or reducing punishment as stipulated in Party regulations.
